California Infertility and IVF Insurance Coverage

California Infertility Health Insurance Coverage Law

California infertility and IVF insurance is mandated by law - partially.

The California Infertility Health Insurance law requires insurers to
offer coverage for infertility diagnosis and treatment.  Insurers must let employers know infertility health insurance coverage is available as an option to offer to employees. It also does not force employers to include infertility coverage in their employee insurance plans.

The CA mandate does not include In Vitro Fertilization (IVF).   What if your employer does not offer an infertility insurance option, or you need IVF?

California IVF insurance is not mandated. The California law specifically exempts insurers from having to offer in vitro fertilization coverage (IVF).

Also, the law does not require employers that are religious organizations to offer coverage for treatment that conflicts with the organization's religious values.

California Infertility Insurance Definitions

The California Infertility Insurance law defines infertility as:

  • The presence of a demonstrated condition recognized by a licensed physician and surgeon as a cause of infertility; or
  • The inability to conceive a pregnancy or carry a pregnancy to a live birth after a year or more of sexual relations without contraception.

Employers decide if they will provide the following benefits to their employees:

  • Diagnosis and diagnostic tests for infertility
  • Fertility drugs
  • Surgery
  • Gamete Intrafallopian Transfer (GIFT)

Not every employer is subject to the California mandate. If your employer is headquartered in another state then the laws in the headquarter state apply. Also consider purchasing supplemental insurance before beginning any infertility treatment. Remember your goal: getting pregnant means additional insurance needs.

Supplemental PoliciesSupplemental PoliciesSupplemental maternity policies fill important holes for growing families.  Mom may need to miss time from work before delivery, and may be in and out of the hospital if she experiences a high-risk pregnancy.  If your infant(s) require a NICU stay there may be extra bills to pay.  Couples undergoing infertility treatment may find an added bonus for multiples!
