Twenty five percent of pregnancies will experience one of more complications, requiring that you miss unplanned time from work prior to delivery. Your policy may support your earnings during this time so you can focus on your baby’s health. Postpartum disorders may delay your return to work by weeks or months. Workers compensation is a mandated program that indemnifies earnings in the event of an on the job accident or illness. It does also provide some support for medical care, but does not provide any benefit conditions derived from off the job activities.

Ohio Maternity Leave Laws

Ohio maternity leave laws for private employees consist only of federal regulations. State employees enjoy additional family leave protections. The federal regulations that may apply to all workers includes: Family Medical Leave Act (FMLA), Pregnancy Discrimination Act, and Americans with Disabilities Act (ADA). Each regulation has qualifying criteria that may exclude certain populations. 

If your employer is not bound by these rules, or your condition extends beyond the protected twelve weeks your employer may not be required to hold your job open. After you recover, you may be eligible for unemployment benefits if you lost your job for this reason.

State employees are eligible for six weeks of leave to care for a newborn or adopted child. State employees are eligible for salary continuation payments of up to 70% for the first 26 weeks, and 50% for an additional 18 months. Payments are available for women suffering complications prior to delivery, and for recovery afterwards. Employees are also eligible for up to 6 months of unpaid leave.
