Most policies contain a nine-month exclusion for normal delivery. Purchase your pregnancy disability policy a few months before getting pregnant to avoid delivering inside the exclusion period. Not every pregnancy lasts exactly nine months. In fact, many deliver pre-term and it is possible to become pregnant after your policy effective date yet still give birth inside the exclusion period.

    Pennsylvania State Disability Insurance

Pennsylvania state disability insurance consists solely of Social Security Disability benefits. The PA Bureau of Disability Determination is a state agency that assists in determining whether Pennsylvania citizens are eligible for federal disability benefits. There is a very strict definition of disability. You must be unable to do any substantial work, and your medical condition must have lasted, or be expected to last at least one year.

PA does not have state mandated short term disability insurance. Residents who commute out of state may have access to state short term disability programs. Coverage is mandated based upon where you work, rather than where you live.

PA citizens crossing the Delaware River to work in NJ will be covered by that state's temporary disability insurance program. NJ pays up to $572 per week, and covers up to 2/3 of gross income. State residents crossing the border into NY state will be covered by that program. Benefits are 50% of gross income, capping out at only $170 per week. Benefit payments are taxed in both states. Of course residents of both states that commute into Pennsylvania may lose these mandated benefits.

I commute from NJ to Philly, and assumed Pennsylvania had state short term disability.  Good thing I learned otherwise and found an alternative.

PA Maternity Leave Laws Safeguard Your Job

PA maternity leave laws differ for private and state employees, and those who commute to New Jersey.

Maternity leave laws for private and some government employees (federal, county, and municipal employees) consist of only three federal statutes. These laws apply to certain workers in Pennsylvania, and may provide unpaid job protected leave, and help you keep your health benefits - if your employer is subject to these laws.

State workers in Pennsylvania may request up to six months of extended parental care leave. This is unpaid leave without health benefits.

Many residents cross over the Delaware River to work in the Garden State. Anyone taking the Commodore Barry, Ben Franklin, or any other of the many bridges to work will be covered by NJ maternity leave protections. In addition to the state disability coverage noted above, there is Paid Family Leave and a supplemental Family Leave policy that extends job protected leave time for women who experience complications and need more than the 12 weeks afforded by the Federal FMLA.

Unemployment insurance may sometimes be utilized. Your employer may not be bound by family leave laws, or perhaps your disability lasted longer than 12 weeks. In these cases your employer is not obligated to hold your job open. After recovery, you may be eligible for benefits.

Maternity Leave LawsMaternity Leave LawsPA does not have any state specific laws pertaining to maternity and family leave. There are several Federal rules which provide unpaid job protected leave for certain classes of workers. See how the laws work, and find out if you are covered.
